Younzee Terms of Use (App)

These Terms of Use (hereinafter referred to as the “Terms”) are intended to define the rules governing the use of the mobile application “Younzee” (hereinafter referred to as the “Application”), published by the company Younzee – R.C.S. Paris No. 904 727 906 – Registered address: 1 rue de Stockholm, 75008 Paris (hereinafter referred to as “Younzee”).

By installing the Application on your device and/or by accessing the Application as a visitor and/or user, you unconditionally and fully accept all of the Terms set out below. If you do not wish to accept these Terms, please do not access or use the Application.

Any visit to and/or use of the Application must comply with these Terms.

Article 1. Definitions

The terms beginning with a capital letter in these Terms of Use, whether used in the singular or plural, shall have the meanings set out below:

“Application” refers to the software application “Younzee” published and provided by Younzee, giving access to the Services, and available for free on the Apple App Store and Google Play Store for download by the User on their Apple iOS or Android device. The Application also includes Content, software, programs, tools (for programming, navigation, etc.), databases, operating systems, documentation, and all other elements and services that compose it, as well as updates and new versions that may be provided by Younzee.

“Content” refers, without limitation, to the structure of the Application, editorial content, drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, company names, audiovisual works, multimedia works, visual content, audio and sound content, and any other content present within the Application and/or any other element forming part of the Application.

“Services” refers to the various features and services offered through the Application.

“User” or “You” refers to a natural person, adult or minor having previously obtained authorization from their parents or legal guardian, who has downloaded the Application for their own use, strictly for personal and non-commercial purposes, without any direct or indirect profit.

Article 2. Purpose of the Application

Younzee is a free mobile application that combines the expertise of our personal shoppers with artificial intelligence to intelligently suggest outfits based on your wardrobe, taking into account the weather, your schedule, and your personality. Every morning, you no longer have to waste time finding the perfect outfit for the day.

Younzee does it for you by providing personalized outfit recommendations.

With Younzee, you can also:

Catalog your entire wardrobe right in your pocket.
Create new outfits using items from your wardrobe.
Save your favorite looks.
Record and purchase clothing items.

Article 3. Access to the Application

To access and use the Application, you must have a compatible phone or mobile device and Internet access. The Application is available for free download from the Apple App Store and Google Play Store on the following mobile devices:

Apple® iPhone® with a minimum operating system of iOS 13.0
Mobile devices with a minimum operating system of Android® 5.1

The Application’s software version may be updated from time to time to add new features and services.

Article 4. Geolocation

The use of the Application’s geolocation feature requires the user’s prior and explicit consent to be located via GPS. To do this, the user must, if they wish, activate the geolocation function directly in their mobile device settings and allow the Application to access it. This feature can be enabled or disabled at any time, free of charge.

The geolocation feature allows the Application to suggest outfits that are appropriate for the weather at the user’s current location.

Article 5. Financial Terms

The Application is offered to Users free of charge, excluding any subscription fees charged by your mobile operator, Internet connection or access costs, and any potential additional charges for data usage.

Paid features may be offered during the use of the Application.

Article 6. Application of the Terms of Use

The Terms of Use apply to all Users of the Application and the Services.

Users are encouraged to carefully read the Terms of Use each time they access the Application. The Terms are accessible via a hyperlink in the “Settings” section (represented by a gear icon) of the Application and may be modified at any time without prior notice by Younzee.

The Application may be regularly updated. Accordingly, any Application downloaded by a User has a limited validity period, taking into account these mandatory updates and potential technical, legislative, or regulatory changes, which are beyond Younzee’s control.

Article 7. Intellectual Property of the Application

Younzee is the exclusive owner of all intellectual property rights related to the Application and its Content, subject to the rights of companies whose licenses are used by VERA, as listed on https://vera-app.fr.

Without prejudice to the provisions of Article 7, nothing in these Terms of Use may be interpreted as a transfer, sale, assignment, grant, license, loan, rental, or authorization—direct or indirect—granted by Younzee to the User over the Application, its Content, and/or the Services.

Article 8. License to Use

Younzee grants the User a personal, non-exclusive, revocable, non-assignable, non-transferable, worldwide, and free-of-charge right to use the Application, its Content, and the Services solely for their personal needs within the scope of using the Application and Services, excluding any other purpose.

The User is strictly prohibited from accessing and/or using the Application’s source code and/or any software components of the Application.

The User does not acquire any intellectual property rights in the Application, the Content, and/or the Services, nor any rights other than those expressly granted herein.

This license does not grant the User any right to use the Content.

Therefore, the User is prohibited from reproducing, displaying, adapting, and/or exploiting any of the Content.

The User expressly agrees that the use of the Application shall not infringe Younzee’s rights, and in particular, shall not constitute counterfeiting, unfair competition, or parasitic use of the Content.

Article 9. User Obligations

The User expressly agrees to:

Download the Application on their device exclusively for personal, non-commercial use.
Not reproduce, permanently or temporarily, the Application, in whole or in part, by any means or in any form.
Not use software or processes intended to copy the Content without prior written authorization from Younzee.
Not perform any adaptation, modification, translation, transcription, arrangement, compilation, decompilation, assembly, disassembly, transcoding, or reverse engineering of all or part of the Application, Services, and/or Content.
Not export the Application or merge all or part of the Application with other software programs.
Only make short quotations, analyses, and reproductions for press reviews or other uses expressly authorized by law, within the limits and conditions set by law, and provided that the author and source are cited.
Explicitly refrain from using software or devices that may disrupt the proper functioning of the Application or engage in actions that impose a disproportionate load on Younzee’s infrastructure.
Not extract or reuse, including for private purposes, without prior written authorization from Younzee, a substantial or non-substantial part of the content of the databases and archives created by the Application.
Not implement systems that could hack the Application and/or Content, in whole or in part, or that violate these Terms of Use.
Inform Younzee immediately upon learning of any hacking, in particular any illicit or non-contractual use of the Application and/or Content, regardless of the method of dissemination.
Not sell, rent, sublicense, or distribute the Application and/or Content to third parties in any way.

Article 10. Protection of Personal Data

The collection and use of personal data by Younzee related to the Services are carried out in accordance with Younzee’s Privacy Policy, available at https://www.younzee.com/privacy. Personal data collected through the Younzee mobile application with your consent is processed for the following purposes:

User Account: gender, first and last name, email address, password to authenticate on the Application; optionally: mobile phone number to share all or part of your wardrobe with your contacts, date of birth, profile photo, clothing sizes (top and bottom), shoe size, weight, height, body shape, measurements (chest, neck, shoulders, waist, hips, foot width and length), fashion preferences, average clothing purchase budget, and number of items in the wardrobe, to provide personalized features in the Application.
Virtual Wardrobe: photos of the User’s clothes, shoes, bags, and other accessories (on hangers or on the floor, no recognizable people in the photo) to catalog your entire wardrobe, suggest daily outfits from your wardrobe, and generate new outfits from individual items; likes/dislikes on suggested outfits to refine recommendations.
Swipe Feature: User preferences (likes/dislikes) on suggested clothing and their characteristics (color, pattern, brand, cut, shape, material) to provide more relevant recommendations and better personalize the Application.
Clothing Purchases: User preferences on favorited or purchased items and their characteristics (color, pattern, brand, cut, shape, material) to improve the recommendation algorithm of the swipe feature.
Fashion Assistant: any information provided during interactions with the fashion assistant to allow it to adapt its service to the User.
Geolocation Access: the User may be geolocated via GPS if they choose (otherwise, this information will be purely declarative; in the absence of information, an approximation will be made via IP address) to access weather data for the User’s location and suggest daily outfits suitable for the climate conditions.

To ensure the confidentiality and security of your personal data, and in particular to protect it against unlawful or accidental destruction, loss, alteration, disclosure, or unauthorized access, Younzee implements appropriate technical and organizational measures in accordance with applicable legal provisions. These measures include technical protections (such as firewalls) and organizational measures (such as ID/password systems and physical protection).

You have the right to access your personal data, have it corrected or deleted, transfer it or have it transferred to a third party, request a limitation of processing, or object to its processing. Younzee will comply with your request, subject to applicable legal obligations.

You also have the right to withdraw your consent to the processing of your data at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

For confidentiality and data protection purposes, Younzee must be able to verify your identity to respond to your request. To do so, you must provide a photocopy of an identity document showing your date and place of birth and bearing your signature, in accordance with regulations on the protection of natural persons regarding the processing of personal data and the free movement of such data.

Article 11. Availability of the Application

Younzee undertakes to make its best efforts to secure access, consultation, and use of the Application’s Services. The Application is accessible 24 hours a day, 7 days a week, except in cases of force majeure or events beyond Younzee’s control, and subject to possible outages and maintenance operations necessary for the proper functioning of the Application. Maintenance operations may be carried out without prior notice to Users.

Article 12. Limitation of Warranty

It is the responsibility of each User to take all appropriate measures to protect their own data and/or software stored on their computer and mobile devices from any damage.

The User acknowledges and accepts the characteristics and limitations of the Internet network, including functional and technical performance, connection and access issues, network availability and congestion, network failure or saturation, transit times, access to online information, response times for displaying, consulting, querying, or transferring data, interruption risks, lack of protection of certain data against potential theft or hacking, virus contamination risks, etc., for which Younzee cannot be held liable.

Younzee cannot be held responsible:

For defects, loss, delays, or errors in data transmission beyond its control.
For sending messages and/or data to incorrect, incomplete, or wrong addresses.
If data does not reach Younzee for any reason, or if the data received is unreadable or impossible to process.
If the User cannot access or use the Site, the Application, and/or the Services for any reason.
If the connection is interrupted for any reason.

Furthermore, Younzee disclaims any liability in the event of misuse of the device and/or incidents related to device usage during the use of the Application. Younzee shall not be held liable for any damage of any kind caused to Users, their devices, computer and mobile equipment, or the data stored thereon, nor for any resulting impact on their personal, professional, or commercial activities.

Article 13. Changes to the Terms of Use

The applicable Terms of Use are those in effect on the date the User accesses and uses the Application. Younzee reserves the right to modify, at any time, all or part of the Terms of Use without prior notice to adapt to changes in the Services, technical, legal, or regulatory developments, or when introducing new features.

Any changes made by Younzee will be communicated to Users simply by posting them online. They are deemed accepted without reservation by any User who accesses the Application after the changes are posted. Users are therefore encouraged to review the Terms of Use regularly.

Any new Service incorporating new technologies or features that improve the quality of existing Services will also be subject to these Terms of Use, unless expressly stated otherwise.

Article 14. Termination

Younzee may terminate your use of the Application at any time by giving you prior notice of termination.

Upon termination, (a) the rights and licenses granted to you will be revoked, and you must cease all use of the Application.

Article 16. Governing Law

These Terms of Use are governed by French law. Any dispute or disagreement relating to the execution or interpretation of these Terms that cannot be resolved amicably between the parties will be submitted to the competent courts within the jurisdiction of the Paris Court of Appeal.
